Viejos y nuevos retos del derecho civil en Navarra [Old and new challenges in civil law of Navarre]

Abstract

The civil law of Navarra has constituted throughout its history a shaping element of its identity. The incorporation of the old Kingdom to the Crown of Castile was carried out without detriment to its civil normative capacity, which was maintained until the 19th century. The process of civil codification crystallized in Navarra in the text of Compilation of Foral Civil Law, the last and most complete of the rules object of compilation. The paper reviews the historical evolution experienced, the normative modifications that have affected the Navarra Compilation up until now, and its future challenges within the constitutional framework established by article 149.1.8 Spanish Constitution.
