Abstract

The discussion of divorce law, under article 43 of the Constitution, which was adopted when the two Catholic minorities: the Agrarian minority and the Basque-Navarrese minority, were absent from the voting, having left the Chamber on October 14 to protest against the approval of article 24 of the constitution draft, was a brief one and had a low political profile. During it the two competing theses faced each other: the traditional Catholic one, based on Christian and natural law principles and the Republican one, inspired on the freedom of the marriage members and on modern liberal constitutional practice in several European and American countries. The only intervention of Basque-Navarrese minority is worth noting: Jesús María de Leizaola was the speaker...
